PL8M8 eGift Card Offer Terms and Conditions

Information on how to participate and the rewards form part of these Terms and Conditions. Participation in this offer is deemed acceptance of these Terms and Conditions.
This offer is only open to Queensland residents who are PPQ 'VIP' customers ("PL8 M8s") aged 18 years or over who receive an invitation to submit a claim in this offer ("Eligible PL8 M8s").
To participate, Eligible PL8 M8s must follow these instructions, during the Offer Period: (a) The invitation email includes a unique Gift Card number and a unique redemption code, which acts as a special gift card only available as part of this offer ("PPQ eGift Card") for a $50 discount towards the purchase of a Colour, Theme, Business, Signature Series, Euro, 2x2 Flexi, or Prestige registration plate or the purchase of a standard PPQ Gift Voucher, subject to the terms and conditions specified herein; (b) Visit PPQ.COM.AU and follow the Create A Plate® instructions to choose their desired personalised registration plate and, when prompted during the checkout process, enter their unique redemption code, during the Offer Period; (c) Make additional payment via American Express, Visa or MasterCard (online or by telephone), by cheque or money order (by mail) or by cash (in person at the PPQ office) to pay the balance in order to complete the transaction. Alternatively, the purchase may be made under a LayBy payment plan, subject to payment of a deposit (the minimum deposit will be displayed at the checkout depending on the product being purchased) at the time of ordering (after the $50 discount is applied). Payment for the order (or the deposit if initiating a LayBy purchase) must be received during the Offer Period. If payment is received after the Offer Period ends, the customer will not be entitled to redeem the PPQ eGift Card and will be required to pay for the full value of the purchase, subject to the Promoter's discretion.
This offer is strictly limited to the first 5,000 Eligible PL8 M8s to complete the checkout process as set out in clause 3. Once 5,000 PPQ eGift Cards have been redeemed, any remaining PPQ eGift Cards will automatically become void and will not be honoured.
Each Eligible PL8 M8 is only entitled to claim one (1) PPQ eGift Card. Each unique redemption code may only be used once. Only one (1) PPQ eGift Card may be redeemed per transaction.
The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimant's identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claims process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible entries will be deemed invalid.
Offer commences 15/11/2011 and ends 11:59pm AEST on 31/12/2011 or once 5,000 Gift Cards have been redeemed through the online checkout process, whichever is first to occur ("Offer Period").
PPQ eGift Cards available in connection with this offer are different from other PPQ Gift Vouchers and are subject to the following terms and conditions: (a) PPQ eGift Cards are only redeemable towards the purchase of a new set of Colour, Theme, Business, Signature Series, Euro, 2x2 Flexi, or Prestige personalised registration plates or the purchase of a standard PPQ Gift Voucher. PPQ eGift Cards are not redeemable towards the purchase of Standard, Monochrome or Accessory style plates, remakes, restyles, or any other goods or services. PPQ eGift Cards cannot be applied towards the creation of Business plate artwork designs. (b) PPQ eGift Cards cannot be used towards the payment of existing LayBy purchases. If a PPQ eGift Card is applied to a new LayBy purchase for the purchase of an eligible personalised registration plate or standard PPQ Gift Voucher and that LayBy is subsequently cancelled, the PPQ eGift Card will not be returned or refunded, and the value of the PPQ eGift Card cannot be used to offset any cancellation fees. LayBy purchases are subject to PPQ's standard LayBy terms and conditions. (c) PPQ eGift Cards are transferrable and may be used as gifts. (d) PPQ eGift Cards, or any unused portion of a PPQ eGift Cards, are not exchangeable and cannot be taken as cash. Any unused balance of the PPQ eGift Card will not be awarded as cash. (e) All personalised plates orders are subject to PPQ's standard Terms and Conditions (available at PPQ.COM.AU) and PPQ’s Delivery Policy. Personalised plates will be manufactured as soon as payment is finalised and may take up to 14 working days to reach the customer. (f) PPQ is not responsible for lost, stolen or damaged PPQ eGift Cards. Defaced, mutilated, altered, lost or stolen PPQ eGift Cards will not be replaced, refunded or redeemed. (g) PPQ makes no representation or commitment to supply any person with respect to any chosen personalised plate combination until such time as the order has been correctly submitted to PPQ, payment finalised, and the order approved by Department of Transport and Main Roads. (h) PPQ will not issue a refund (or replacement PPQ eGift Card) if a customer changes their mind after an order has been received by PPQ. (i) PPQ and Department of Transport and Main Roads have absolute discretion in the manufacture of personalised plates and have the right to stop manufacture or recall any personalised plates considered inappropriate or offensive at any time after the personalised plate order process has been undertaken. (j) Pursuant to the Transport Operations (Road Use Management - Vehicle Registration) Regulation 2010 (QLD), acquiring personalised plates gives the customer the right to use the personalised plates (by either keeping them without them being attached to a vehicle or attaching them to the corresponding vehicle in the correct manner). The right to use the personalised plates also includes the right to transfer the right to use the personalised plates to another person (subject to any relevant fee that may be imposed by Department of Transport and Main Roads). Although acquisition of personalised plates gives the customer the right to use the personalised plates, pursuant to the Transport Operations (Road Use Management - Vehicle Registration) Regulation 2010 (QLD), at all times the personalised plates remain the property of the State of Queensland. (k) Pursuant to the Transport Operations (Road Use Management - Vehicle Registration) Regulation 2010 (QLD), personalised plates that are damaged, lost, destroyed or stolen must be reported as such within 14 days after the registered operator discovers that they have been damaged, lost, destroyed or stolen. Failure to report may constitute an offence. Replacement of personalised plates does require payment of a fee.
If a PPQ eGift Card is redeemed for the purchase of a PPQ Gift Voucher, the Eligible PL8 M8 is responsible for any ancillary costs associated with redeeming the PPQ Gift Voucher. Any unused balance of the PPQ Gift Voucher will not be awarded as cash. Redemption of the PPQ Gift Voucher is subject to the standard terms and conditions of the issuer, including those specified on the PPQ Gift Voucher.
Any ancillary costs associated with accessing the PPQ website or redeeming PPQ eGift Cards are the customer's responsibility.
The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically enter repeatedly is prohibited and will render all claims submitted by that claimant invalid.
If this offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; (e) use of the PPQ website; (f) use of a PPQ eGift Cards; (g) non-availability of personalised plates; (h) the rejection of, or failure to receive, an order; (i) any act or omission of PPQ; or (j) the provision of inaccurate or incomplete information provided by any person.
Without limitation to the foregoing, PPQ will not be liable for any consequences arising from unintended functionality related errors or technical glitches of whatsoever nature that may temporarily impact on the normal operation of the PPQ website generally, or the Create A Plate® selection/order processing on-line system in particular (including but not limited to the temporary acceptance of otherwise non-valid plate combinations and designs), and/or for any such errors or glitches caused by a user's attempt to manipulate, tamper with, or otherwise override the normal intended functioning of the Create A Plate® on-line system, including but not limited to any attempt to enter invalid personalised plate category and/or character combinations via the creation of multiple tab sessions, or by any other means.
The Promoter collects personal information in order to conduct the offer and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Participation is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All claims become the property of the Promoter. The Promoter's decision is final and no correspondence will be entered into.
