Item 3 - Commencement and completion dates
The commencement date of this LayBy Agreement is the date a deposit is received by PPQ. A deposit must be received within seven (7) days of the LayBy being initialised or the LayBy application will be cancelled.
The finalisation date for completing the LayBy is no later than four (4) months for Colour, Theme, Business, Euro, Signature Series and 2x2 Flexi plates, or seven (7) months for Prestige, A Plate and 7C Prestige plates, from the commencement date.

, the termination charge will include the manufacturing cost of the personalised plates in addition to the termination charge of $50 or $250 (whichever is applicable) set out above.
If you cancel
the LayBy or PPQ terminates
the LayBy Agreement for breach of a term of the LayBy Agreement, the termination charge will also include any bank fees or charges incurred by dishonoured payments and other reasonable costs in relation to the LayBy Agreement. These fees and costs (if applicable) are in addition to the termination charge of $50 or $250 (whichever is applicable) and manufacturing costs (if applicable) set out above.
Item 7 - Failure to pay an installment payment
In the event you fail to meet any one of the payments detailed in Item 5, or if a cheque is dishonoured when presented for payment, the LayBy Agreement may be terminated at the discretion of PPQ. Any bank fees or charges incurred by dishonoured payments will be charged to the person named in Item 1 and form part of the termination charge where the LayBy Agreement is cancelled or terminated. If this should occur and the LayBy Agreement is terminated, the conditions outlined in Item 6 will apply.
Item 8 - Failure to complete
In the event you fail to complete all payments by the period detailed in Item 3, the LayBy Agreement may be terminated at the discretion of PPQ. If this should occur and the LayBy Agreement is terminated, the conditions outlined in Item 6 will apply.
Item 9 - General conditions
All personalised plate manufacturing orders are subject to PPQ's Delivery Policy.
PPQ and the Department of Transport and Main Roads have absolute discretion in the manufacture of personalised plates and have the right to stop manufacture or recall any personalised plates considered inappropriate or offensive at any time after the personalised plate order process has been undertaken.
Pursuant to the Transport Operations (Road Use Management - Vehicle Registration) Regulation 2010
(QLD), acquiring personalised plates gives you, as the customer, the right to use the personalised plates (by either keeping them without them being attached to a vehicle or attaching them to a vehicle in the correct manner). The right to use the personalised plates also includes the right to transfer the right to use the personalised plates to another person (subject to any relevant fee that may be imposed by the Department of Transport and Main Roads). Although acquisition of the personalised plates gives you the right to use the personalised plates, pursuant to the Transport Operations (Road Use Management - Vehicle Registration) Regulation 2010
(QLD), at all times the personalised plates remain the property of the State of Queensland.
The Australian Consumer Law (ACL) provides consumers with guarantees that cannot be excluded, restricted or modified. The LayBy Agreement does not affect any rights you have under the ACL or any other legal rights which cannot be excluded or modified. However, to the extent permitted by the ACL and subject to any other legal restriction, PPQ excludes any terms, conditions, warranties, guarantees or other liability that may apply to PPQ in respect of the LayBy Agreement or anything done under it. For services other than services of a kind ordinarily acquired for personal, domestic or household use or consumption, PPQ limits its liability, as permitted by the ACL, at its option, to the re-supply of the services or the payment of the cost of having the services supplied again. Unless you acquire anything under the Layby Agreement as an individual and wholly or predominantly for personal, domestic or household use or consumption and PPQ cannot exclude liability, then PPQ is not liable for any loss or damage, including any indirect, special, consequential or economic loss or damage, whether or not arising from default or negligence by PPQ or its employees, agents or contractors.
